These Website & App Terms of Use (“Terms”) apply to your use of:

1. The websites operated by *Allied Fitness Zone Sdn. Bhd.* and other companies in the AFZ Group, including *[insert main website URL, e.g. [www.alliedfitnesszone.com.my](http://www.alliedfitnesszone.com.my)]* (collectively, the “Site”); and
2. Any online services, content or features made available by AFZ through the Site, the *“MyAFZ Appointment”* app         (powered by Glofox), AFZ-branded Trainerize app, and related digital platforms (collectively, the “Online Services”).

These Terms are a legal agreement between you and:

    - Allied Fitness Zone Sdn. Bhd. (202201029428 / 1475125-M);
    - First Alliance Fitness Sdn. Bhd. (202301046902 / 1540816-H);
    - Second Alliance Fitness Sdn. Bhd. (202501003783 / 1605196-X);

and any related companies operating studios or services under the “Allied Fitness Zone” brand (together, the *“AFZ Group”*, “AFZ”, “we”, “us” or “our”).

By accessing or using the Site or Online Services, you agree to be bound by these Terms and our *Privacy Policy*. If you do not agree, please do not use the Site or Online Services.

1. SCOPE OF THESE TERMS

• These Terms govern your general access to and use of the Site and Online Services for information, browsing, account access and booking purposes.

• If you *purchase* any AFZ programme, package or service (whether online, in-app or in person), your purchase and participation are additionally governed by the *AFZ Master Agreement (Version [2.1])* and the specific *Product Details* of the programme you choose.

• If there is any conflict between these Terms and the AFZ Master Agreement in relation to a purchased programme, the *AFZ Master Agreement and Product Details will prevail* for that programme.

2. ELIGIBILITY & ACCOUNT REGISTRATION

• You must be at least *18 years old* to create an account, make purchases or enter into contracts with AFZ. If you are under 18, a *parent or legal guardian* must review and agree to the AFZ Master Agreement and act as the contracting party.

• When you register an account or submit any form, you agree to:
  - provide true, accurate and complete information;
  - keep your login credentials confidential;
  - not share your account with others or allow others to use your identity.

• You are responsible for all activities that occur under your account. If you believe your account has been compromised, you must inform AFZ as soon as reasonably possible.

 

3. CONTENT ON THE SITE & ONLINE SERVICES

• All content provided on the Site and through the Online Services, including text, images, videos, graphics, logos, articles, guides and other materials (“AFZ Content”), is for *general information and educational purposes only*.

• AFZ Content *does not constitute medical advice*, physiotherapy, diagnosis, treatment or a substitute for consultation with qualified healthcare professionals. You should not ignore or delay seeking medical advice because of any information obtained from the Site, Online Services or AFZ Content.

• AFZ does not guarantee that all information on the Site is always current, complete or error-free. We reserve the right to update, correct or remove content at any time without notice.

4. INTELLECTUAL PROPERTY

• Unless otherwise stated, all AFZ Content and the design, layout and underlying code of the Site and Online Services are owned by AFZ or its licensors and are protected by copyright, trademark and other intellectual property laws.

• You may view, download or print reasonable portions of AFZ Content *for your personal, non-commercial use only*, provided you do not:

• remove any copyright, trademark or other proprietary notices;

• modify the content;

• reproduce, distribute, republish or publicly display AFZ Content for commercial purposes without our prior written consent.

•  “Allied Fitness Zone”, “AFZ” and related logos, names and branding are trademarks of the AFZ Group. You may not use these marks without our prior written permission.

5. ACCEPTABLE USE & PROHIBITED CONDUCT

You agree *not* to use the Site or Online Services to:

• engage in any unlawful, fraudulent or abusive activity;

• upload or transmit any material that is defamatory, obscene, offensive, hateful or otherwise inappropriate;

• harass, threaten or harm other users or AFZ staff;

• attempt to gain unauthorised access to any systems, data or accounts;

• probe, scan or test the vulnerability of any AFZ system or network;

• reverse engineer, decompile or modify the Site or Online Services;

• create fake accounts or misrepresent your identity;

• bypass or circumvent any security or access controls;

• scrape, harvest or systematically download content or data without prior written permission;

• upload or introduce viruses, malware, harmful code or other materials that could damage or interfere with the Site or Online Services.

 

AFZ reserves the right to suspend or terminate your access if we reasonably believe you have violated these Terms.

6. ONLINE BOOKINGS, PURCHASES & PAYMENTS

• The Site and Online Services may allow you to:

       - view programme information and schedules;
       - book classes or personal training sessions;
       - purchase programmes, Learning Packs, PT packages and events.

• All bookings and purchases are subject to availability and to the specific terms stated in the *Product Details, as well as the **AFZ Master Agreement*.

• Prices shown are subject to change and may include applicable taxes where required by law. AFZ is not responsible for any additional fees charged by your bank, card issuer or payment provider.

• Payments processed online may involve third-party payment gateways (such as *Stripe* or equivalent). AFZ does not store your full card details on its own servers and relies on such providers’ security measures.

7. HEALTH, SAFETY & NON-MEDICAL DISCLAIMER

• By using AFZ Content, following online exercises, or joining any AFZ programme (in-person or online), you acknowledge and agree that:
  - physical exercise carries inherent risks, including risk of injury;

       - you are responsible for choosing appropriate activities and exercising within your own limits;
       -  you should stop immediately if you experience pain, dizziness, chest discomfort, shortness of breath or any warning signs;
      - you are encouraged to seek advice from a qualified doctor or healthcare professional before starting        any new exercise or nutrition programme, especially if you have pre-existing health conditions, are pregnant, or are recovering from injury.

• AFZ coaches provide *exercise and movement training*, not medical treatment. They do not act as doctors, physiotherapists or other healthcare practitioners, and do not provide diagnosis or prescribe medication.

•   AFZ shall not be liable for any injury, loss or damage resulting from:

     - your failure to seek appropriate medical advice;
     - your decision to follow exercises or advice that are not suitable for your health condition;
     - unsafe training environments chosen by you when training outside AFZ studios;
     - ignoring coach instructions or warning signs.

 

 

​ 8. THIRD-PARTY LINKS & SERVICES

• The Site and Online Services may contain links to third-party websites, apps or services that are not owned or controlled by AFZ. These links are provided for convenience only.

• AFZ is *not responsible* for the content, privacy practices, security or accuracy of any third-party sites or services. Your use of third-party services is at your own risk and subject to those third parties’ terms and policies.

9. AVAILABILITY, CHANGES & TERMINATION

• AFZ does not guarantee that the Site or Online Services will always be available, uninterrupted or error-free. We may suspend, withdraw or restrict access for maintenance, upgrades or other reasons.

• AFZ may modify these Terms at any time. The updated Terms will be posted on the Site with a revised *“Last Updated”* date. Your continued use of the Site or Online Services after changes are made constitutes your acceptance of the updated Terms.

• AFZ may, at its discretion, suspend or terminate your access to the Site or Online Services if you breach these Terms or engage in conduct that AFZ reasonably considers disruptive or harmful.

10. LIMITATION OF LIABILITY

• To the fullest extent permitted by law, AFZ and its directors, employees, coaches and agents shall not be liable for any:
  - indirect, incidental, special, consequential or punitive damages;
  - loss of profits, revenue, data, goodwill or business opportunities;
  - damages arising from your use of or inability to use the Site or Online Services;

       - reliance on information obtained from AFZ Content.

• Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for personal injury or death caused by proven negligence.

 

11. INDEMNITY

You agree to indemnify and hold harmless AFZ, its directors, employees, coaches and agents from and against any claims, losses, damages, liabilities, costs and expenses (including reasonable legal fees) arising out of:

- your breach of these Terms;
- your misuse of the Site, Online Services or AFZ Content;
- your violation of any law or third-party rights.

 

12. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of *Malaysia*, without regard to conflict of law principles. You agree to submit to the non-exclusive jurisdiction of the courts of Malaysia in relation to any dispute arising from or in connection with these Terms or your use of the Site and Online Services.

13. LANGUAGE

These Terms may be translated into other languages for convenience. In the event of any inconsistency or ambiguity between the English version and any translation, the *English version shall prevail*.
